Annual Letter and Special Meeting Notice, Plans, Budget and Dues

This article contains a notice of special meeting, the summary of the association’s activities during 2015, plans for 2016 including important dates and our 2016 dues notice.
 
Notice of Special Meeting – Saturday, February 20, 2016, 10 a.m.
 
The Silver Shekel Owners Association is holding a special meeting on Saturday, February 20, 2016, 10:00 a.m. at 512 Shekel Lane. All members are encouraged to attend or return their voting proxy with their dues payment, before February 20, 2016, or via email to raffertyrich@gmail.com. The purpose of the meeting is the election by the Association to have the provisions of the Colorado Common Interest ownership Act (CCIOA) apply to all of the future affairs of the Association.  The relevant Colorado Statue (C.R.S. §38-3.3-188).
 
As we have shared with membership in many forms over the last few years, the current Declarations of Protective Covenants (Covenants) were adopted, one for each filing 1, 2 and 3, in the late 60s and early 70s and have not been amended since. The board of directors has polled the membership and evaluated methods to bring our foundational documents in compliance with current Colorado law. After consultation with the Association’s attorney, the board has adopted a resolution recommending that the Association is treated under CCIOA. The board recommends this action as the most expedient and cost-effective means to bring our foundational documents in compliance with current Colorado law and assure the continued legal recognition of the association. If the membership elects to have the provisions of the CCIOA apply to the Association will be deemed to be subject to the same duties, restrictions and penalties and have the same powers and privileges as an association established after June 30, 1992.  The board does not intend to change any fundamental rules, dues or operations of the association. The specific matter before the Association membership is the following:
 
The Silver Shekel Owners Association, Inc. (“Association”), pursuant to C.R.S. §38-33.3-118, hereby elects to be treated under the provisions of the Colorado Common Interest Ownership Act, C.R.S. §38-33.3-101, et seq., as amended and supplemented from time to time (the “Act”), a copy of which is attached hereto.  In the event of any conflict between the provisions of the Declaration of Protective Covenants for Silver Shekel, a Real Estate Subdivision, recorded on October 30, 1967, under Reception No. 108051 in the records of the Summit County, Colorado, Clerk & Recorder, the Declaration of Protective Covenants for Silver Shekel No. 2, A Real Estate Subdivision, recorded on July 26, 1968, under Reception No. 110065 in the records of the Summit County, Colorado, Clerk & Recorder, and the Declaration of Protective Covenants for Silver Shekel No. 3, A Real Estate Subdivision, recorded on September 4, 1970, under Reception No. 117430 in the records of the Summit County, Colorado, Clerk & Recorder (the “Declarations”), the provisions of the Act shall govern unless otherwise specifically excepted by an amendment to the Declarations.

Summary of 2015
 
Many of our residents participated in the Summit County brush pick up program last summer for the second year in a row. County Government is seeking the funds to repeat the program again in 2016.  When the details are available we will post them on our website and send an email to our members.
Our annual clean up, annual picnic / meeting were held with continued success. During our annual cleanup, many neighbors helped each other with yard clean up.  We love this community spirit. The summer road was graded again this year. Your board of directors and many of your neighbors attended Town of Breckenridge, Planning Commission and Town Council hearings on the master plan for the McCain property, just west of our subdivision. Due to continued popularity, we have acquired and installed another bank of mailboxes at the base of Fairview.
 
Our website at www.silver-shekel.net was updated a year ago. If you have not done so already, you should request access to our member’s only area of the website.  In the member’s section, you will find our membership directory, financial information and minutes from our meetings. While in the member’s only area, please review and update your contact information, so we can continue to reach you.
 
Plans for 2016 
 
Your board has met and approved the budget for 2016.  We expect to provide the same services for the unchanged $30 annual dues as recent years.  The Association’s fund balance at December 31, 2015, was $15,217. A budget summary follows. The deficit budget, caused primarily by extraordinary legal expense associated with the business of our Special meeting, is covered by our accumulated surplus. For questions on association finances, please contact our treasurer, Rich Rafferty, or any member of the board.

We expect to conduct our annual clean-up, summer road grading, and annual block party / meeting again this year. You will receive email notice of these events. More information is already available on our website. Your board has set tentative dates for these events as follows.

To help us properly record your payment, please include your Silver Shekel property address on your check wth your Dues and our Special Meeting Proxy. As is evident from our budget above, your dues are the primary source of support for our association. We appreciate your support.
